Refutation of Minority Jurisprudence
and Its Dangers to Muslim Minorities

This book criticizes “minority jurisprudence” (fiqh al-aqalliyyat) on the grounds of method in the principles of jurisprudence (usul al-fiqh). The author argues that some of its fatwas stretched the meanings of public interest (maslaha), the higher objectives (maqasid) and “the lesser of two harms” until they contradicted definitive texts, and he distinguishes necessity grounded in the Shari‘a from necessity judged by reason alone.
He works through practical examples, including interest-based mortgages, zakat and inheritance, recourse to secular courts and taking part in Western elections, answers the arguments of those who permit them, such as the stories of Yusuf and of the Najashi, and then sets out the maxim of “the lesser of two evils” and its conditions.
